Linfo IP v. Trustpilot
Panel: Moore, Chen, Bissoon
In Linfo IP, LLC v. Trustpilot, Inc., the Federal Circuit dismissed the appeal as moot after the parties entered into a settlement agreement granting Trustpilot a worldwide, irrevocable license to the patent-in-suit in exchange for a settlement fee paid "[i]n consideration of the settlement of all claims in the Lawsuits." The court held that Linfo, as the patent owner challenging the district court's § 101 invalidity determination, mooted its own appeal through the settlement because Trustpilot—having obtained a license resolving the infringement issue—no longer had any stake in defending the invalidity ruling, rendering the parties no longer adversaries under Article III's case-or-controversy requirement. No costs were awarded.
